TERMS AND CONDITIONS FOR THE USE OF RECRUITING SERVICES OF W EXECUTIVE ESPANA
Section I: Description of the service, subject of the service, and registration
Art. 1 Description of the service offered
The aim of W EXECUTIVE ESPANA (hereinafter “the COMPANY”) is to help the candidate establish an employment relationship with our client companies. To make more efficient the management of the applications and offer more opportunities to its candidates, the Company enable the candidates to apply through its website, allowing them to submit their applications quickly and easily and to use the recruiting services offered by our company (the “Services”).
Art. 2 What is this document?
These terms and conditions govern the relationship between the candidate (also “user”) and THE COMPANY, based in Madrid, , for the provision of the Services offered.
Art. 3 Apply through the website
The user can apply for specific job positions promoted by THE COMPANY on its website and submit spontaneous applications. The candidate has to fill out the data collection form with their name, surname, email address, phone number and to attach their resume. If they wish, they can also add the location and sector of activities.
Art. 4 Services offered by THE COMPANY
By applying through the website, the candidate benefits from the following Services:
a) the opportunity to apply for specific job positions advertised by THE COMPANY;
b) the opportunity to be part of our pool of candidates, with the evaluation of the profile for job positions other than those for which the application was submitted if the profile matches the requirements;
c) the possibility to manage directly the information provided;
d) the possibility of receiving job proposals in line with the profile;
e) the communication of the candidate’s data to potential employers in the form of a “long list” and “profile,” containing non-identifying data (candidate’s age; place of residence; educational qualifications; professional experiences; skills and competencies) in the first phase of the selection; the communication of identifying information only in the final phase of interviews.
The candidate acknowledges and accepts that the registration on the website implies that THE COMPANY will perform all the activities indicated in this article, which are considered strictly necessary for the provision of the Services. Therefore, if the candidate does not intend to use all the described Services, they are requested not to register on the website.
Recruiting services for candidates are free of charge. It is possible to terminate this contract of Service at any time by contacting us at the contact details indicated below.
Art. 5 Provision of data
The candidate provides their personal data by:
a) filling in all the fields marked as mandatory in the data collection form on the website at the time of the registration;
b) uploading their resume (“cv”) directly into the platform before completing the registration. The data included in the cv must be necessary and relevant for the evaluation of the application. THE COMPANY can process the candidates’ data only to the extent and if it is necessary for job placement. Therefore, candidates must not add information defined as “sensitive personal data”” under art. 9 of the General Data Protection Regulation 2016/679(GDPR), such as information about racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as data relating to health or sexual path or sexual orientation. Only if such information is essential for a specific role, we will ask the candidate to provide it. The processing of personal data will be carried out in compliance with the GDPR and the applicable laws, in accordance with the privacy policy always available on the website.
Section II: Unauthorized use, data deletion, and liability limitations
Art. 6 Unauthorized use of the website
The candidate shall not use the website or the Services for any illegal purpose or activity or send defamatory, slanderous, implicitly or explicitly offensive, vulgar, obscene, threatening, abusive, hateful, racist, discriminatory, threatening, or capable of causing outrage, discomfort, embarrassment, anxiety, or harassment to people, or include links to pornographic, indecent, or sexually explicit content of any kind, as determined at THE COMPANY’s discretion. The candidate shall not use, copy, adapt, modify, prepare derivative works based on, distribute, license, sell, transfer, publicly display, publicly perform, transmit, broadcast, or otherwise exploit the content on the website, except as expressly permitted by these Terms and Conditions. The candidate shall not perform, attempt to perform, or encourage, assist others in performing any of the following actions during access or use of the Service: (1) use any THE COMPANY trademark, logo, or other proprietary information, the layout and design of any page or form without express written consent; (2) access or tamper with non-public areas of the website, THE COMPANY’s or suppliers’ computer systems; (3) test the vulnerability of the website or breach security; (4) circumvent any technical measure implemented by THE COMPANY or third parties to protect its content; (5) modify, decompile, disassemble, reverse engineer, tamper with or otherwise attempt to infer the source code of the application provided to the candidate or any other part of the platform; (6) provide, during or after registration, false information regarding their identity.
Art. 7 Deletion
The candidate can cancel their registration and request the deletion of their profile at any time by contacting THE COMPANY at info@wexecutive.es
Art. 8 Compensation and liability limitations
To the extent permitted by applicable law, THE COMPANY shall not be liable for loss of profit, contracts, or any incidental or indirect damages or expenses resulting from the use or inability to use the Services by the candidates. Except as otherwise set forth by mandatory law, THE COMPANY does not provide any warranty, express or implied, including the warranty of suitability, accuracy, reliability of the Services and content on the website.
Section III: Miscellaneous
Art. 9 Use and interruption of the Service
The use of the Services offered through the website requires the use of compatible devices owned by the candidate and access to an Internet connection. THE COMPANY reserves the right to interrupt the Services for maintenance or system updates, providing prior notice to users.
THE COMPANY may suspend or immediately cancel the candidate’s registration if they do not comply with the obligations indicated in these terms and conditions of service.
Art. 10 Updating the Terms and Conditions
These Terms and Conditions may be subject to modifications. In such circumstances, THE COMPANY will inform the candidates, specifying the time frame within which they may cancel their registration and the effective date of the new provisions. The candidate’s acceptance of the new terms and conditions will be considered implicit if no request for cancellation is made.
Art. 11 Assignment of the contract
The candidate hereby accepts that THE COMPANY may assign these Terms and Conditions (including in cases of transfer of the business or a business unit) and, by accepting them, expressly gives prior consent to such assignment. This assignment, along with the related execution methods, will be notified to the candidate in advance. The candidate may not assign these Terms and Conditions.
Art. 12 Intellectual property rights
The candidate agrees to access the website solely for the use of the Services and in compliance with the provisions of these Terms and Conditions. No part of the website may be reproduced in any form or by any means. The candidate agrees not to modify, rent, lease, lend, sell, distribute, or create derivative works based on the website.
Art. 13 Age requirements
The use of the Services offered through the website is reserved for candidates who have reached the age of eighteen
Art. 14 Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Spain.
As a consumer residing in a Member State of the European Union, you shall benefit from the mandatory consumer protection provisions of your country of residence.
For any disputes arising from these Terms and Conditions, you may bring legal proceedings before the courts of your place of residence.
This does not affect your right to access alternative dispute resolution (ADR/ODR) mechanisms as provided under European Union law.
The application of any additional consumer protection provisions remains unaffected.
